Term & Conditions

This Terms of Service (“ToS”) governs your access to and use of Listybox’s platform and its integration with marketplace APIs (including Etsy). By using the Service, you agree to: (1) comply with Etsy’s API Terms of Use and Trademark Policy; (2) respect intellectual property rights and refrain from prohibited behaviors (e.g., scraping, impersonation); (3) grant Listybox limited rights to operate your account and listings; and (4) accept our disclaimers, limitations of liability, and indemnification provisions.

1. Acceptance of Terms

By accessing or using Listybox (the “Service”), you agree to these ToS and the Privacy Policy. Continued use after updates indicates acceptance of the revised ToS.

2. Definitions

  • “Service” means Listybox’s web application and related tools for creating, managing, and publishing print-on-demand listings.

  • “User” means any individual or entity accessing the Service.

  • “Etsy API” refers to the application programming interface provided by Etsy, governed by Etsy’s API Terms of Use.

3. License to Use the Service

Subject to your compliance with these ToS, Listybox grants you a limited, non-exclusive, non-transferable license to access and use the Service to create and publish product listings, including via the Etsy API. This license is revocable if you violate Etsy’s API Terms of Use  or these ToS.

4. User Obligations and Prohibited Conduct

  1. Compliance with Etsy Policies: You must comply with the Etsy API Terms of Use, Shopify Terms of Use, and Seller Policy when using marketplace integrations  .

  2. Trademark Usage: If you use Etsy’s trademarks in marketing, you must follow Etsy’s Trademark Policy: include the exact disclaimer “The term ‘Etsy’ is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy”  .

  3. No Scraping or Circumvention: You may not scrape, spider, or circumvent access controls of Etsy or any other marketplace  .

  4. No Impersonation: Do not misrepresent affiliation with Etsy or any third party.

  5. Quality and Ownership: You represent that all content you provide (titles, images, descriptions) is owned by you or properly licensed and does not infringe third-party rights  .

5. Intellectual Property

  • Listybox IP: All platform code, documentation, and branding are Listybox’s exclusive property.

  • User-Generated Content: You retain ownership of your Product Listings and Artwork. By submitting content, you grant Listybox a worldwide, royalty-free license to display, modify, and transmit it solely to provide the Service.

6. Compliance with Etsy Marketplace Rules

You acknowledge that any listing published via the Etsy integration must comply with Etsy’s Seller Policy (handmade/design requirements, prohibited items, IP rules)  . Listybox provides tools (keyword filters, trademark checks) to help enforce these rules, but ultimate responsibility remains yours.

7. Privacy and Data Use

Your use of the Etsy API and other integrations is subject to our Privacy Policy, which explains what data we collect, how we use it, and how we protect it. We do not use marketplace data for any external AI/ML training or analytics  .

8. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED “AS IS.” LISTYBOX DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT  . TO THE MAXIMUM EXTENT PERMITTED BY LAW, LISTYBOX’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS YOU PAID IN THE PRIOR 12 MONTHS.

9. Indemnification

You agree to indemnify, defend, and hold harmless Listybox and its affiliates from any claims or liabilities arising from your use of the Service, your violation of these ToS, or your breach of any third-party right (including Etsy’s policies)  .

10. Termination

Listybox may suspend or terminate your access if you breach these ToS or Etsy’s API Terms. Upon termination, licenses granted herein immediately cease; you must stop all use of the Service and remove references to any marketplace integrations  .

11. Changes to These Terms

We may update these ToS at any time; material changes will be communicated via email or an in-app notice. Continued use after notice constitutes your acceptance.

12. Governing Law

These ToS are governed by the laws of [Your Jurisdiction], without regard to conflicts-of-law principles. Any dispute arising under these ToS shall be resolved in the competent courts of that jurisdiction.
